Conflicto de competencia suscitado entre el Juzgado Único Penal del Circuito Especializado de Sincelejo y el Juzgado Tercero Penal del Circuito de Cartagena.
La controversia se generó en torno a las diferentes interpretaciones que hicieron las autoridades judiciales involucradas del factor territorial.
Concluye la Corte que el despacho que debe dar trámite a la solicitud de amparo es el de la ciudad de Sincelejo, en tanto allí se produjo la supuesta vulneración del derecho fundamental invocado, en la medida en que la entidad accionada se encuentra ubicada ahí.
Además, por ser el lugar elegido por el accionante.
Se dispone enviar el expediente al Juzgado Único Penal del Circuito Especializado de Sincelejo, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.

- Primero. DEJAR SIN EFECTOS los autos del 17 de noviembre y del 11 de diciembre de 2017 proferidos por el Juzgado Único Penal del Circuito Especializado de Sincelejo (Sucre), dentro del trámite de la acción de tutela formulada por la señora Socorro Bettin de López contra la Secretaría de Educación Departamental de Sucre.
- Segundo. REMITIR el expediente ICC-3268 al Juzgado Único Penal del Circuito Especializado de Sincelejo (Sucre), para que, de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar.
- Tercero. Por la Secretaría General de la Corporación, COMUNICAR la decisión adoptada en esta providencia a la parte accionante y al Juzgado
- Tercero. Penal del Circuito de Cartagena (Bolívar).
